When you request a charter, Château Noir acts as your agent (the agent of the customer) to find and arrange a flight with a direct air carrier. We are not the agent of any operator unless a quote says otherwise in writing. We never use phrases such as “our jets” or “our fleet”, and nothing on this site should be read as Château Noir offering to operate a flight.
2. What we disclose before you pay
Before we accept any payment we give you a written quote that states: the name of the direct air carrier (operator) that will operate the flight and its FAA Part 135 certificate number (or foreign equivalent); our capacity as air charter broker acting as your agent; whether we carry liability insurance and, if so, the type and amount; the total cost of the charter, including the federal excise tax on air transportation (7.5%) and the domestic segment fee per passenger; any business relationship we have with the operator (normally none); and any third-party fees we know of (for example de-icing, overnight crew, landing or handling fees), or that none are known. Tax and fee figures are estimates based on current published rates and the itinerary in the quote.
You confirm that you have read these disclosures, by typing your name, before payment is accepted. We keep a record of that acknowledgment.
3. Operational control
The operator named in your quote has sole operational control of the aircraft and is solely responsible for the flight, crew, maintenance, safety and compliance with FAA regulations. Aircraft type is subject to the operator’s availability; if the operator must substitute, we will tell you before departure and you may decline the substitute for a full refund.
4. Operator vetting
We only source operators that hold a valid FAA Part 135 certificate (or equivalent foreign authority) and an independent safety rating of ARGUS Gold or higher or Wyvern Wingman or Registered. Ratings are third-party audits and are not a guarantee of safety.
5. Insurance
Our current insurance status as broker: loading…. Each written quote also states our insurance status. The operator carries its own aircraft liability insurance as required by law; ask us for its certificate of insurance.
6. Payments and fees
You pay Château Noir the total in your quote, in full or as a deposit with the balance due before departure, through our payment processor, Stripe. Our compensation is a broker fee included in the charter price. We pay the operator on your behalf. We take no payment until the operator has confirmed in writing that it will operate your flight; until then your quote shows “Pending operator confirmation”.
7. Refunds
If the flight cannot be performed as agreed for any reason other than your own cancellation (for example the operator cancels or cannot supply the aircraft, you do not accept a substitute aircraft, or the flight is grounded for weather, safety or regulatory reasons), you receive a full and prompt refund of everything you paid us, whether or not we have already paid the operator. Refunds go back to the original card through Stripe, normally within 7 business days of the cancellation. If you cancel yourself, the operator’s cancellation terms given with your quote apply.
