What may be listed, how we verify sellers, and the nature of our role.
Last updated 15 October 2026. Questions may be addressed to legal@chateaunoirluxury.com.
01Allowed listings
Estates and property for sale or long-term let; motor vehicles for sale; vehicle hire by licensed rental companies; art, antiques, timepieces, jewellery, furniture and collectibles; private aircraft for sale and charter operators; and licensed chauffeur services. Listings must describe a specific, genuinely available item or service.
02Not allowed
Stolen, counterfeit or replica goods; items without lawful title; firearms and weapons; any item made of or containing elephant or mammoth ivory, rhinoceros horn, tortoiseshell (sea turtle shell) or bald or golden eagle feathers or parts, whatever its age and even with permits; other items protected under CITES or the US Endangered Species Act without the correct permits; cultural property without lawful export; antiquities or archaeological objects without documented provenance; recalled or unroadworthy vehicles presented as roadworthy; aircraft or operators without valid authority; adult content; and anything illegal where the seller or item is located.
03Fair housing
Château Noir follows the federal Fair Housing Act (42 U.S.C. §3604(c)) and state and local fair housing laws. Listings of homes for sale or for long-term let must not state or imply any preference, limitation or discrimination based on race, color, religion, sex (including sexual orientation and gender identity), disability, familial status or national origin, or any other class protected where the property is located. Examples we reject include “adults only”, “no children”, “perfect for singles”, “Christian community” or “no wheelchairs”. Describe the property, not the people you want to live in it.
Every housing listing goes through a fair housing review before it is published, and we remove listings that break this policy. Equal Housing Opportunity.
04Antiquities, art and protected wildlife
Antiquities, archaeological objects and cultural property must include provenance documents (for example export licences, prior sale records or a documented ownership history) showing that the item left its country of origin lawfully. Before approving high-value art and antiques we check them against the FBI National Stolen Art File and may check the Art Loss Register.
We do not accept any item made of or containing elephant or mammoth ivory, rhinoceros horn, tortoiseshell, or bald or golden eagle feathers or parts, regardless of age or permits.
05Rentals and chauffeurs
Rental and chauffeur companies must upload a current certificate of commercial insurance and give their operator licence or permit number. Interstate for-hire passenger carriers must also give their USDOT and MC (operating authority) numbers.
06Texas real estate agents
Texas real estate license holders who list property must give the name of their sponsoring (listing) brokerage, which we show with the listing, as TREC advertising rules (22 TAC §535.155) require.
07Eigentums- oder Vollmachtsnachweis
Every submission must include a document showing that the seller owns the item or is authorised to offer it, plus a signed attestation on the form. Examples: a title deed, land registry extract or exclusive listing agreement (property); a vehicle title, registration or dealer stock record (motors); a fleet or rental licence (rentals); an invoice, certificate of authenticity, provenance record or consignment agreement (collections); an aircraft registration and a sale mandate, or an FAA Part 135 or equivalent air operator certificate (jets); a chauffeur or private-hire operator licence (chauffeurs).
Documents are used only for review and are never published. They are deleted when the listing is approved or rejected, and in any case within 90 days of upload. You may redact personal details that are not needed to show ownership or authority.
08Verification and the Verified seller badge
Our review checks that the document matches the listing (names, addresses, identifiers such as VIN or aircraft registration), that the contact details are real, and that photos are not copied from elsewhere. Listings that pass may show a “Verified seller” badge. The badge means we saw documents that appeared genuine at the time of review; it is not a guarantee, and buyers must still carry out their own due diligence.
09Advertiser-only disclaimer
Apart from air charter, Château Noir only advertises listings. We are not a broker, agent, dealer, auctioneer or escrow service for listed items, we take no commission on them, and we are not a party to those transactions. Inquiries go to the seller.
10Private aviation: 14 CFR Part 295
Château Noir is an air charter broker, not a direct air carrier. We do not own or operate aircraft, and we never hold ourselves out as an operator. Every charter we arrange is operated by an FAA-certificated direct air carrier (14 CFR Part 135 or equivalent foreign authority) that holds operational control of the flight. Before accepting any payment we disclose, in writing, the operator’s name, our role, our insurance status and the total cost. Aircraft-for-sale listings remain advertisements by their sellers. See our Hinweis zur Charter-Vermittlung.
11Photos and content
You must own or have licensed every photo and description. Do not use manufacturer press images or other sellers’ photos without permission. We may resize photos and adjust formatting.
12Accuracy and updates
Please keep prices and availability current, and let us know promptly when an item is sold or no longer available.
13Enforcement
We may reject or remove listings that break this policy. Rejected paid listings are refunded under our Erstattungsrichtlinie; listings removed for breaches are not.
