1. Who we are

Château Noir (“we”, “us”) operates an online advertising marketplace at https://chateaunoirluxury.com. Château Noir opera dal Texas, USA. We publish listings supplied by sellers, owners, dealers, galleries and operators (“sellers”) for estates and property, motor vehicles for sale and hire, art and collectibles, private aircraft and chauffeur services.

By using the site, submitting a listing, or sending an inquiry, you agree to these Terms. If you do not agree, please do not use the site.

2. Eligibility: 18 and over

You must be at least 18 years old, and of the age of majority where you live, to create an account, send an inquiry, request or pay for a charter, or submit a listing. By creating an account you confirm that you meet this requirement. We may close any account we reasonably believe belongs to someone under 18.

3. Advertiser only, except air charter

Château Noir is an advertising platform for estates, motors, rentals, collections, aircraft sales and chauffeurs. For those listings we are not a real estate broker or agent, motor dealer, rental agency, auction house, appraiser, escrow or payment agent for buyers, or transport provider, and we are not a party to any sale, rental or service agreement between users. The one exception is private air charter: when you request a charter quote, Château Noir acts as an air charter broker under 14 CFR Part 295, as described in our Informativa broker charter. We are never an air carrier and never operate aircraft.

We do not take any commission on sales, rentals or bookings. Sellers may pay flat, upfront fees for optional Featured or Premium placement; these fees buy visibility only and do not change the nature of our role.

4. Listings and accuracy

Sellers are solely responsible for their listings, including accuracy, legality, pricing, availability, title, authenticity, condition, licensing and insurance. We review submissions and may check proof of ownership or authority, but a review, approval or “Verified seller” badge is not a guarantee, warranty, appraisal or endorsement of any item, seller or operator.

Buyers and renters must independently verify every listing and should use licensed professionals (for example attorneys, surveyors, inspectors, escrow agents and appraisers) before committing funds.

Any listing marked SAMPLE is a demonstration with original illustrations and fictional details. It is not a real offer.

5. Seller obligations

Sellers must be the owner of the item or hold written authority to offer it, must own or have licensed every photo and text submitted, and must comply with all laws that apply to the item and to the seller (including licensing, consumer, export and anti-money-laundering rules). 6. Fees and payment

Basic listings are free. Featured ($99) and Premium ($249) placements run for 30 days from publication and are paid in advance by card through our payment processor, Stripe. Prices are in US dollars. Refunds are governed by our Politica di rimborso.

7. Inquiries

Inquiry forms forward your message to the listing party. Once you are in contact with a seller, any dealing is solely between you and that seller.

8. Acceptable use

You must not post unlawful, fraudulent, misleading or infringing content; scrape the site; send spam; attempt to access accounts or systems you are not authorized to use; or use the site to launder money or evade sanctions.

9. Removal and suspension

We may refuse, edit for formatting, suspend or remove any listing, and suspend any user, at our discretion, including where we suspect fraud or a breach of these Terms.

10. Intellectual property

The Château Noir name, logo and site design belong to us. Sellers grant us a non-exclusive, worldwide, royalty-free licence to display and promote their listing content on the site and in our marketing while the listing is active. Make and model names are trademarks of their owners and are used descriptively.

11. Copyright and DMCA

We respect intellectual property rights and respond to notices under the US Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content on Château Noir infringes your copyright, send a notice to our designated agent as described on our Copyright & DMCA page. Our designated agent is registered with the US Copyright Office (registration DMCA-1083042). Send notices to legal@chateaunoirluxury.com.

We remove or disable access to material that is the subject of a valid notice, notify the seller who posted it, and accept counter-notices as the law provides. We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

12. Account deletion

You may delete your account at any time from your account page or by emailing legal@chateaunoirluxury.com. See our Informativa sulla privacy for what is deleted and what we must keep.

13. Disclaimers and limitation of liability

The site is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties and are not liable for any loss arising from listings, transactions between users, or use of the site. Where liability cannot be excluded, our total liability to you is limited to the fees you paid us in the 12 months before the claim.

14. Indemnity

You agree to indemnify us against claims arising from your listings, your dealings with other users, or your breach of these Terms.

15. Changes and governing law

We may update these Terms; the date above shows the latest version. These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules, and disputes will be heard in the courts located in Texas, unless the law of your residence requires otherwise.

16. Not advice

Nothing on the site is legal, tax, investment or financial advice. USD equivalents shown in filters are approximate.
